Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Socialday ("we", "our", or "us") governing your access to and use of the platform at https://www.socialday.in (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms and our Privacy Policy, which is incorporated by reference. Please read them carefully — they cover how accounts work, how bookings and billing work, what you can and can't do on the platform, and how disputes get resolved. If you don't agree, don't use the Service.
1. Definitions
- “Customer” — anyone who uses the Service to discover, contact, or book a Creator, including individuals, businesses, brands, and marketing agencies.
- “Creator” — anyone who registers a public profile to list services, connect social profiles, and receive Bookings.
- “Staff” — our own internal team members, provisioned by us, who operate the platform through a separate corporate console.
- “Booking” — a request a Customer sends a Creator, and everything that follows: the message thread, status changes, and any review.
- “Content” — anything a user adds to the Service: profile details, portfolio and social links, service listings, Booking messages, and reviews.
- “Booking Credits” — a one-time purchase that raises your monthly Booking allowance beyond your subscription plan's limit.
2. Eligibility & acceptance
By using Socialday, you represent and warrant that: (a) you're at least 18 years of age; (b) you have the legal capacity to enter into these Terms; (c) if you're registering on behalf of a business or agency, you have the authority to bind that entity to these Terms — in that case, “you” refers to both you individually and that entity; (d) your use of the Service doesn't violate any applicable law; and (e) all information you provide is accurate, current, and complete.
We may, at our discretion, refuse to register an account, or may later suspend one, if we reasonably believe any of these representations is untrue.
3. Description of the service
Socialday is a creator discovery and collaboration platform. It brings together businesses, brands, marketing agencies, and individual customers on one side, and independent creators, influencers, and content creators on the other, so the two can find each other and work together. Finding the right creator for a campaign has traditionally meant searching across different social platforms, checking profiles manually, comparing audiences, and sending countless messages — the Service is built to make that process simpler. The Service includes:
- Creator discovery and search by location, social platform, category, audience, and content type
- Public creator profiles with portfolios, services, pricing, and social profiles connected across platforms including Instagram, YouTube, TikTok, Facebook, X, LinkedIn, Pinterest, Snapchat, and websites/blogs
- Services listed by content format — such as reels, stories, videos, short-form video, live streams, sponsored posts, and website/article promotion
- Booking requests, in-thread messaging, and Booking status tracking
- Ratings and reviews tied to completed Bookings
- Favorites, notifications, and support tickets
- Subscription plans and Booking Credits for both Customers and Creators, billed via Razorpay
- An internal, role-restricted console for our own Staff to operate the platform
We may modify, add, suspend, or discontinue any part of the Service at any time, with reasonable notice where practical. We aren't liable to you or any third party for doing so.
4. Account types
4.1 Customer accounts
A Customer account may represent an individual looking for a single creator, or a business, brand, or marketing agency running a broader campaign. Customer accounts can search, browse, save favorites, send Booking requests, message Creators, and leave reviews after a completed Booking.
4.2 Creator accounts
A Creator account gets a public profile, the ability to connect social platforms, publish services with pricing and delivery timelines, receive and respond to Booking requests, and reply publicly to reviews. Creator accounts go through our moderation and, optionally, verification process, and we may decline, suspend, or remove a listing that violates these Terms.
4.3 Staff accounts
Staff accounts are provisioned directly by us for our own internal team and are not self-registered. Staff access is scoped by role-based permissions and is used to operate, moderate, and support the platform.
5. Registration & account security
To use the Service, you must create an account. You agree to:
- Provide accurate, current information at registration and keep it updated.
- Keep your login credentials confidential and not share them with anyone else.
- Notify us immediately at hello@socialday.in if you suspect unauthorized access to your account.
- Accept responsibility for all activity that happens under your account.
- Not maintain more than one account per person, per account type, without our consent.
We may disable or terminate any account we reasonably believe violates these Terms, including shared credentials, impersonation, or fraudulent registration. See Section 22 for more on suspension and termination.
6. Creator verification
Creators may optionally apply for a verified badge by submitting supporting information through Settings. Verification is a signal that we've reviewed the submission against our own criteria — it isn't a guarantee, endorsement, or warranty of a Creator's work, character, or business practices, and Customers should still use their own judgment before booking. We may revoke a verified badge at any time if we later determine the underlying information was inaccurate or the Creator's conduct no longer meets our standards.
7. How bookings work
A Booking starts when a Customer sends a request from a Creator's profile, selecting the service categories and platforms they're interested in and describing what they need. From there:
- The Creator is notified and can reply in the same message thread — this moves the Booking from “New” to “Responded.”
- Once the Creator and Customer agree on the details, the Creator confirms the Booking with a schedule and price, moving it to “Confirmed.”
- Once the work is delivered, the Creator marks the Booking “Completed,” which is also what makes the Customer eligible to leave a review.
- Either party can cancel a Booking that isn't already completed, optionally with a reason the other party will see.
The specific price, deliverables, timeline, and any other terms of a Booking are agreed directly between the Customer and the Creator in that thread — we don't set them, and we're not a party to that agreement. See Section 17 for more on our role (or lack of one) in the underlying work.
8. Reviews & ratings
Only a Customer with a completed Booking for a specific Creator can leave a review for that Creator, and only about that Booking. Reviews must reflect a genuine experience — you agree not to post a fake, incentivized, or misleading review, and not to offer or accept payment in exchange for one. A Creator may reply publicly to a review, but can't edit or delete it; only the Customer who wrote a review can edit or delete it. We may remove a review that violates these Terms, and may moderate or hide a review we determine, in our reasonable judgment, is fraudulent, abusive, or unrelated to an actual Booking.
9. Subscription plans, billing & booking credits
9.1 Available plans
Both Customers and Creators start on a free plan and can access paid plans that raise its limits. Current plan details are on the Pricing page and may change from time to time.
9.2 Payment & renewal
Paid subscriptions are processed through Razorpay. By subscribing, you authorize us to charge the applicable fee to your chosen payment method for the billing cycle you select (monthly or yearly), and you agree the subscription renews automatically at the end of each cycle unless cancelled beforehand.
9.3 Taxes & currency
Fees are stated exclusive of applicable taxes, including GST where it applies. You're responsible for any taxes, duties, or levies arising from your subscription, other than taxes based on our own income.
9.4 Plan limits & booking credits
Each plan sets a monthly limit on Bookings and other usage; usage counters reset at the start of each billing cycle. If you reach your plan's limit, you can purchase Booking Credits as a one-time top-up rather than waiting for the next cycle — credits don't expire while your account stays active. Existing data is never deleted for exceeding a limit; you simply can't create new records in that category until the limit resets, you upgrade, or you use a credit.
9.5 Refunds
We generally don't offer refunds for subscription fees or Booking Credits. See our Refund Policy for the limited exceptions and how to request one.
9.6 Price changes
We may update subscription pricing from time to time. We'll give reasonable advance notice before a change takes effect on your next billing cycle; continuing to use a paid plan after the new price takes effect means you accept it.
9.7 Failed payments
If a payment fails — insufficient funds, an expired card, or similar — we may notify you and retry the charge. If payment remains outstanding after reasonable attempts, we may suspend or downgrade your account until it's resolved.
10. Cancellation, downgrade & account closure
You can cancel a paid subscription anytime from Subscription in your dashboard. Your plan stays active until the end of the period you've already paid for, then reverts to the free plan — we don't issue partial refunds for unused time. If you downgrade, data beyond the new plan's limits is preserved, not deleted; you just can't add more until you're back within limits. 11. Service availability
We work to keep Socialday reliably available, but we don't guarantee uninterrupted, error-free service. The Service may be unavailable due to scheduled or emergency maintenance, or outages of third-party infrastructure (payments, database, storage, email delivery) outside our direct control. This isn't a binding uptime SLA, and we're not liable for losses arising from downtime except as described in our Refund Policy.
12. Acceptable use
You agree not to:
- Violate any applicable law or regulation.
- Upload malicious code or attempt to gain unauthorized access to any part of the Service.
- Scrape, crawl, or use bots against the Service in a way that places disproportionate load on it.
- Reverse-engineer or attempt to extract the source code of the Service.
- Impersonate another person, brand, or entity, or post a fraudulent or misleading listing.
- Circumvent Bookings or payments off-platform specifically to avoid fees.
- Post, request, or exchange payment for a fake or incentivized review.
- Send unsolicited bulk messages, or harass, abuse, or threaten other users.
- Post content that infringes someone else's intellectual property or privacy rights.
- Use the Service to facilitate money laundering or other illegal schemes.
We may investigate suspected violations and take any action we consider appropriate, including warnings, content removal, suspension, termination, and cooperating with law enforcement where required.
13. Your content & license
You retain ownership of the Content you add — profile details, portfolio and social links, service listings, Booking messages, and reviews. We don't claim ownership over it.
By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, and display your Content solely to provide and improve the Service — for example, showing your profile in search results, or your review on a Creator's page. This license ends when you delete the content or close your account, except where a copy is reasonably needed to preserve another user's record of a transaction (see our Privacy Policy).
You're responsible for the accuracy and legality of your Content, and you represent that it doesn't infringe anyone else's rights and that you have any permission needed to post it — including permission to display work you didn't create yourself, if that's ever the case.
14. Intellectual property
The Service itself — its software, design, branding, and original content (excluding user Content) — is owned by Socialday or its licensors and protected by applicable intellectual property law. We grant you a limited, non-exclusive, revocable license to use the Service as permitted by these Terms; you may not copy, resell, sublicense, or create derivative works from it, and any use of our branding without written consent is prohibited.
15. Third-party services
The Service integrates with:
- Razorpay — payment processing and subscription billing.
- Google — OAuth-based sign-in.
- Cloud infrastructure providers — database and file storage.
- An email delivery provider — transactional email (welcome, password reset, Booking and review notifications).
Your use of any third-party service is governed by its own terms and privacy policy. We're not responsible for the availability or practices of any third-party service, including a Creator's own connected social platforms — those platforms have their own rules, and a Creator is responsible for complying with them independently of these Terms.
16. Feedback
If you send us ideas, feature requests, or bug reports, you agree that's voluntary and non-confidential, and you grant us a royalty-free license to use it however we see fit — without any obligation to act on it or compensate you.
17. Our role in the customer–creator relationship
Socialday is a discovery and booking platform, not an employer, agent, or business partner of either party to a Booking. A Creator using the Service is an independent contractor, not our employee, and is solely responsible for the quality, legality, timeliness, and delivery of the work they agree to provide. We don't supervise, direct, or guarantee the outcome of any Booking.
We're not a party to the agreement a Customer and Creator reach in a Booking thread, and we're not responsible for a dispute over the quality of work, missed deadlines, or payment made outside the Service. We may, at our discretion, help facilitate an informal resolution between the parties, but we're under no obligation to do so and don't guarantee any particular outcome.
18. In-person meetings & safety
Some Bookings may lead to an in-person shoot, event, or meeting. Any such interaction is entirely between the Customer and the Creator, at their own risk. We don't conduct background checks on users unless explicitly stated as part of our verification program, and even a verified badge is not a safety guarantee (see Section 6). Use ordinary caution when meeting anyone in person as a result of a connection made through the Service — meet in a public place where appropriate, and tell someone else your plans.
19. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
We don't guarantee the quality, safety, legality, or outcome of a Booking, listing, or collaboration arranged between a Customer and a Creator — we provide the platform, not the underlying work. We're not responsible for the actions or conduct of Customers, Creators, or other third parties who use the Service.
20. Limitation of liability
To the maximum extent permitted by law, Socialday and its officers, employees, and service providers aren't liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or lost goodwill — arising from your use of the Service, even if we've been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the three months before the claim, or ₹100, whichever is greater. Some jurisdictions don't allow certain limitations of liability, so some of the above may not apply to you.
21. Indemnification
You agree to indemnify, defend, and hold Socialday harmless from any claim, liability, damage, or expense (including reasonable legal fees) arising from: your use of or inability to use the Service; your violation of these Terms or applicable law; your Content; your infringement of any third party's rights; or a dispute between you and another user, including a Customer or a Creator you've interacted with through a Booking.
22. Suspension & termination
22.1 By you
You can stop using the Service and cancel a subscription anytime per Section 10. To request full account deletion, contact us at hello@socialday.in.
22.2 By us
We may suspend or terminate your account at any time, with or without notice, if you violate these Terms, we reasonably believe your account is involved in fraud or abuse, we're required to by law or a valid legal request, or you fail to pay fees when due. Where practical, we'll explain why.
22.3 Effect of termination
On termination, your access ends immediately. Sections that by their nature should survive (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any others that make sense to survive by their content) continue to apply.
23. Force majeure
We're not liable for delay or failure to perform caused by circumstances beyond our reasonable control — natural disasters, war, civil unrest, government action, internet or infrastructure provider failures, or denial-of-service attacks. If a force majeure event materially prevents us from operating the Service for an extended period, we'll do our best to keep you informed and to resume normal operation as soon as reasonably possible.
24. Export control & compliance
You agree to comply with all applicable trade, export control, and economic sanctions laws in connection with your use of the Service. You represent that you're not located in, or a resident of, any country or region subject to a comprehensive sanctions regime that would prohibit your use of the Service, and that you're not on any government restricted-party list that would prohibit us from providing the Service to you.
25. Governing law & jurisdiction
These Terms are governed by the laws of India, including the Information Technology Act, 2000. Disputes that can't be resolved informally are subject to the exclusive jurisdiction of the competent courts of India.
26. Dispute resolution
Before pursuing formal proceedings, contact us at hello@socialday.in so we can try to resolve the issue informally first. We aim to respond and try to work things out within 15 business days of you raising a concern.
27. General provisions
26.1 Entire agreement
These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and Socialday regarding the Service, and supersede any prior agreement on the same subject.
26.2 Severability & waiver
If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a right doesn't waive it, and any waiver is only effective if made in writing.
26.3 Assignment
You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets, or by operation of law.
26.4 Relationship of the parties
Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and Socialday.
26.5 Notices
Notices from you to us must be sent by email to hello@socialday.in. We may provide notices to you by email to the address on your account, or through a prominent notice within the Service.
28. Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll post the updated Terms here with a new “last updated” date, and where appropriate, notify registered users. Continuing to use the Service after a change takes effect means you accept the revised Terms; if you don't agree, you should stop using the Service and may cancel any subscription per Section 10.
